SPECIALIST AGREEMENT

INTRODUCTION

This Specialist Agreement, and all policies and additional terms posted on and in our site, applications, tools and quoting services (collectively "Services") set out the terms on which Econo Repairs offers you access to and use of our Services. You agree to comply with all terms of this User Agreement when accessing or using our Services. Exhibit A Processes and Requirements is part of this agreement. The entity you are contracting with is: Econo Repairs 4101 E 42nd Street STE 8, Odessa, Texas.

In this Specialist Agreement, the entity is referred to as " Econo Repairs," "we," or "us." And the freelance specialists, and repair shops are referred as you, specialists, services providers, or sellers.

Please be advised that this Specialist Agreement contains provisions that govern how claims you and we have against each other are resolved (see "Disclaimer of Warranties; Limitation of Liability" and "Legal Disputes" provisions below).

STATEMENT OF AGREEMENT

ECONO REPAIRS

Econo Repairs is a marketplace that allows users to sell and buy repair services in a variety of pricing formats and locations. The actual contract for sale is directly between the Technician, specialist, repair shop and the buyer.

SPECIALIST

Specialist is engaged in the business of providing repair, refurbishment and remanufacturing services to customers either in properly established business locations or at the customer’s location. Specialist will use Econo Repairs marketplace to connect with potential customers. In consideration of the mutual covenants and agreements contained herein, the Parties agree as follows:

TERMS AND CONDITIONS

SERVICES

In consideration of payments received from customers under this Agreement, specialist shall perform, in accordance with the terms of this Agreement, the services called Process and Requirements ("P&R") described in Exhibit A (Process and Requirements "P&R") attached hereto and incorporated by this reference. This Agreement, together with the P&R and any other documents incorporated herein by reference, constitutes the sole and entire agreement of the Parties. This Agreement will govern all Services performed by the specialist for Customers referred to specialist by Econo Repairs or any of its affiliates. In the event of any conflict between the terms of this Agreement and the P&R, the P&R shall govern, unless the P&R expressly states that the terms of this Agreement shall control.

USING ECONO REPAIRS

In connection with using or accessing Econo Repairs you will not:

  1. Post, list or upload content or items in inappropriate categories or areas on our site, or post quotes that you will not honor or post quotes for services or parts that are not available in inventory
  2. Share, disclose, copy or distribute customer data in any form or advertise your business in quotes. Customer privacy must be maintained under all circumstances. Customer data cannot be shared with anyone except for law enforcement purposes
  3. Use our Services if you are not able to form legally binding contracts (for example, if you are under 18 years old), or are temporarily or indefinitely suspended from using our sites, services, applications or tools
  4. Fail to honor your quoted price for device repairs, unless you have a valid reason as set out in an Econo Repairs policy, for example, the customer has not described the exact problem with the device, or the device needs more than the part for which the quote was given
  5. Fail to deliver promised/quoted services, unless you have a valid reason as set out in an Econo Repairs policy, for example, the customer fails to comply with the posted terms for example time restrictions in your listing or you cannot contact the customer
  6. Manipulate the price of any item or interfere with any other user's listings, or posting false quotes
  7. Post false, inaccurate, misleading, deceptive, defamatory, or libelous content
  8. Transfer your Econo Repairs account (including Feedback) and user ID to another party without our consent
  9. Distribute viruses or any other technologies that may harm Econo Repairs or the interests or property of users
  10. Infringe the copyright, trademark, patent, publicity, moral, database, and/or other intellectual property rights (collectively, "Intellectual Property Rights") that belong to or are licensed to Econo Repairs. Some, but not all, actions that may constitute infringement are reproducing, performing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to Econo Repairs
  11. Infringe any Intellectual Property Rights that belong to third parties affected by your use of the Services or post content that does not belong to you
  12. Commercialize any Econo Repairs application or any information or software associated with such application, except with the prior express permission of Econo repairs

QUOTE LISTING

When listing your quotes on Econo Repairs, you agree to comply with Econo Repair policies and that:

  1. You are responsible for the accuracy, content, timings, and parts availability of your quotes
  2. Your listing may not be immediately searchable by keyword or category and Econo Repairs cannot guarantee exact listing durations
  3. You enter into a legally binding contract to sell a repair service and parts by listing quotes on Econo Repairs. If your quote for an item is accepted, or if you have the winning quote in case of a manual quote. Your failure to deliver on your quote without a reasonable explanation will have penalties including account termination
  4. Content that violates any of Econo repairs 's policies may be modified, obfuscated or deleted at Econo repairs 's discretion
  5. We may revise product data associated with listings to supplement, remove, or correct information
  6. We strive to create a marketplace where customers can connect with specialists. Therefore, the appearance or placement of listings in search and browse results will depend on a variety of factors, including, but not limited to
    1. Customer's location, search query, browsing site, and history
    2. Item's location, listing format, timing restrictions, price, terms of service, end time, history, and relevance to the user query
    3. Specialist’s history, including listing practices, Detailed Seller Ratings, Econo Repairs policy compliance, Feedback, and defect rate
    4. number of listings matching the buyer's query
  7. To drive a positive user experience, a listing may not appear in some search and browse results regardless of the sort order chosen by the customer
  8. Some advanced listing upgrades will only be visible on certain Services

WARRANT AND ENFORCEMENT

Specialist represents and warrants the following:

  1. All repairs will be performed by qualified personnel meeting or exceeding industry standards
  2. Econo Repairs customers will be completely satisfied with the repair services and parts. If a customer is not satisfied, specialist agrees to remedy the situation, at specialist’s expense, to the customer’s satisfaction unless the customer’s dissatisfaction is a direct result of an error attributable to the customer, in which case, Econo Repairs will help resolve the issue. Econo Repairs dispute resolution decision will be final
  3. Specialists will be responsible to contact the customer, complete the repair work and handover the device to customer after fully testing the device
  4. The quality of repairs and parts will meet or exceed industry standards
  5. Specialist will comply with all applicable laws and regulations related to the proper disposal and recycling of units in its performance of the Services
  6. To the extent Specialist must use new parts in connection with any repair services provided. If OEM parts are not available, specialist will inform customer before starting the repair work
  7. Specialists are responsible to contact the customer, complete the repair work and avoid a charge back. All Specialists must warranty their work and parts to avoid any disputes. Three disputes or chargebacks in a month will disable your account. Also, while we may help facilitate the resolution of disputes through various programs, final outcome of any dispute will depend on the willingness of both parties to work together in resolving a dispute. Econo Repairs will use its best efforts to resolve any dispute in a fair manner. You agree to allow Econo Repairs to contact you by phone or email to help and resolve the dispute. You agree that any dispute resolution decision by Econo Repairs is final.

TERMINATION

Upon termination or expiration of specialist account Econo Repairs shall not be obligated to provide specialist with any information or documentation not already required by this Agreement as of the date of termination. All customer data, repair records on Econo Repairs site are the property of Econo Repairs and Econo Repairs is under no obligation to provide any data or customer records to any specialist even when the data was created by the specialist.

PAYMENT TERMS

In consideration of specialist’s performance of the Services in accordance with this Agreement, Econo Repairs shall pay specialist the payment set forth in the P&R. Econo Repairs agrees to pay all such invoices within thirty (30) days of receipt thereof. Specialist shall be responsible for the calculation and remittance of any and all sales taxes associated with the Services performed pursuant to this Agreement. To the extent any payment terms in this section conflict with those set forth in any P&R attached hereto, the payment terms in the P&R shall prevail

The fees we charge for using our Services are listed on our subscription and sign up page. We also provide the breakdown of these fees in specialist wallet. We may change our specialist fees from time to time by updating the user agreement, but with no advance notice required for temporary promotions or any changes that result in the reduction of fees or commissions. Specialist subscription fee does entitle specialist to exclusive rights to an item exposure on Econo Repairs, whether on a web page, mobile app, or otherwise. We may display third-party advertisements (including links and references thereto) or other content in any part of our Services, in our sole discretion and without consent from, or payment, fee reduction, or other credit to, specialists.

Most Econo Repairs transactions go smoothly, but if there's a problem with a repair, the Econo Repairs will notify you about the dispute. Customers are provided with links to raise a dispute and specialists are notified when the disputes arise. If the dispute is not resolved by the specialist in a timely manner (in two days), Econo Repairs will step in and try to resolve the issue. Dispute resolution may include a partial or full refund to the customer. Money Back Guarantee to the customer helps customers and specialists communicate and resolve issues. You as specialist authorize Econo Repairs to withhold, withdraw, or adjust the refund amount against any available funds in your account. You also authorize Econo Repairs to withdraw money directly from your bank account or charge your credit card on file. You agree to comply with the policy and permit us to make a final decision on any dispute resolution.

If you (the specialist), choose to reimburse a customer, or are required to reimburse a customer or Econo Repairs under the Econo repairs resolution decision, you authorize Econo Repairs to remove the reimbursement amount (in same or other currency) from your account, place the amount on your invoice, and/or charge your payment method on file. You also authorize us to draw the funds out of your bank account if there is not enough balance in the specialist wallet. If we cannot get reimbursement from you, we may collect the outstanding sums using other collection mechanisms, including retaining collection agencies. In addition, you will be subject to late fees. Econo Repairs, or the collection agencies we retain, may also report information about your account to credit bureaus, and as a result, late payments, missed payments, or other defaults on your account may be reflected in your credit report. If you wish to dispute the information Econo Repairs reported to a credit bureau (i.e., Experian, Equifax or TransUnion) please contact us. If you wish to dispute the information a collection agency reported to a credit bureau regarding your account, you must contact the collection agency directly.

CONTENT

Econo Repairs shall retain title to and all ownership rights in any and all text, multimedia or images, data used in providing Services ("Content"), but grants Specialist the right to access and use Content for the purpose of complying with its obligations under this Agreement. All customer data collected by the specialists during the course of providing services under this Agreement ("Customer Data") shall be the sole property of Econo Repairs. During the term of this Agreement, Econo Repairs grants specialist a non-exclusive license to use the Customer Data

When you provide content using the Services (directly or indirectly), you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any and all Intellectual Property Rights (as defined above) you have in that content in connection with our provision, expansion, and promotion of the Services, in any media known now or developed in the future. To the fullest extent permitted under applicable law, you waive your right to enforce your Intellectual Property Rights in that content against Econo Repairs, our assignees, our sublicensees, and their assignees in connection with our, those assignees', and those sublicensees' use of that content in connection with our provision, expansion, and promotion of the Services.

You represent and warrant that, for all such content you provide, you own or otherwise control all necessary rights to do so and to meet your obligations under this User Agreement. You represent and warrant that such content is accurate. You represent and warrant that use of any such content (including derivative works) by us, our users, or others in contract with us, and in compliance with this User Agreement, does not and will not infringe any Intellectual Property Rights of any third party. Econo repairs takes no responsibility and assumes no liability for any content provided by you or any third party.

We offer product data (including images, descriptions and specifications) that are provided by third parties (including Econo repairs users). You may use that content solely in your Econo repairs listings. Econo repairs may modify or revoke that permission at any time in our sole discretion. The product data includes copyrighted, trademarked and other proprietary materials. You agree not to remove any copyright, proprietary, or identification markings in the product data and not to create any derivative works based on that data (other than by including the data in your listings).

We try to offer reliable product data, but cannot promise that the content provided through the Services will always be available, accurate, complete, and up-to-date. You agree that Econo repairs is not responsible for examining or warranting the listings or content provided by third parties through the Services, and that you will not attempt to hold us or our data providers liable for inaccuracies. As a seller, you agree to ensure that content directly associated with your listings is accurate

ECONO REPAIRS PRIVACY POLICY AND DATA SECURITY

This Privacy Policy sets out Econo Repairs Privacy policy with respect to information, including in particular information which identifies you personally (known as 'personally identifiable information' in the USA or 'personal data' in the European Union, which together we refer to as "Personal Data") and other information that is collected from visitors, users, and providers of the Services. Additionally, by using our websites, applications, content, products, and communication channels ("Site"), you acknowledge and agree that Internet transmissions are never completely private or secure.

Econo Repairs will never sell, trade, or otherwise transfer any customer information to outside parties. The term "outside parties" does not include our affiliates, independent specialists, repair technicians, customers, installers, vendors of services, payment processors, website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you. Each of these parties has agreed and complies with the very same privacy policy that we operate by. We also reserve the right to release your information when necessary to comply with law enforcement requests, enforce our site policies, or protect our or others' rights, property, or safety. Non-personally identifiable customer information may be provided to other parties for marketing, advertising, analytics, or other uses.

If Econo repairs provides you with information about another user, you agree you will use the information only for the purposes that it is provided to you. You may not disclose, sell, rent, or distribute a user's information to a third party any purposes. Additionally, you may not use user information for marketing purposes, via electronic or other means, unless you obtain the consent of the specific user to do so.

HOW WE USE DATA

When you sign up, Econo Repairs provides your name, billing address, and credit/debit card information to our payment processor to validate and charge your card or bank information. We also share your personal information with our background check vendors to verify you. We will also share your information with credit reporting agencies if you are in default.

Please read this privacy policy carefully so that you understand how we will treat your information. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted. By using any of our Services, you confirm that you have read, understood and agreed to this privacy policy. DATA SECURITY

All units that enter specialist’s facilities or in possession of the specialist shall be secured and protected at all times against unauthorized access to any data contained therein. For all units that contain hard drives or types of storage devices ("Hard Drives") and are disposed of or otherwise salvaged, the Hard Drives shall be erased or zeroed out in a secure and environmentally safe manner. All Hard Drives must be cleaned or erased of data if (i) Provider reuses Hard Drives in the salvage process

AUTHORIZATION TO CONTACT YOU, POST QUOTES ON YOUR BEHALF, RECORDING CALLS

Econo repairs may contact you using autodialed or prerecorded calls and text messages, at any telephone number that you have provided us, to: (i) ask prices for your repairs services and ask permission to post quotes on your behalf (ii) troubleshoot problems with your account; (iii) resolve a customer dispute; (iv) collect a debt; or (vi) as otherwise necessary to service your account or enforce this User Agreement, our policies, applicable law, or any other agreement we may have with you.

Econo repairs may share your telephone number with its authorized service providers as stated in our User Privacy Notice. These service providers may contact you using autodialed or prerecorded calls and text messages, only as authorized by Econo repairs to carry out the purposes identified above.

Econo repairs may, without further notice or warning and in its discretion, monitor or record telephone conversations you or anyone acting on your behalf has with Econo repairs or its agents for quality control and training purposes, or for its own protection.

GENERAL PROVISIONS

Sellers must meet Econo Repairs rating standards. Ratings average below three star will disable your account not allowing future access to our platform. Failure to meet these standards may result in Econo Repairs charging you additional fees, and/or limiting, restricting, suspending, or downgrading your account.

If we believe you are abusing Econo Repairs and/or our Services in any way, we may, in our sole discretion and without limiting other remedies, limit, suspend, or terminate your user account(s) and access to our Services, delay or remove hosted content, remove any special status associated with your account(s), remove, not display, and/or demote listings, reduce or eliminate any discounts, and take technical and/or legal steps to prevent you from using our Services.

If we believe you are violating our policy on repairing customer devices outside of Econo Repairs system or diverting customers outside our syatem, you may be subject to a range of actions, including limits on your account or restrictions on listings and account features, suspension of your account, application of fees, and recovery of expenses for policy monitoring and enforcement. If you are a repair or installation service provider and you offer or reference your contact information or ask a buyer for their contact information in the context of quoting a price on a repair job before the customer selection from available quotes, you may be liable to pay a final value fee applicable to that item, even if the customer does not accept your quote.

We may cancel unconfirmed accounts or accounts that have been inactive for a long time. Additionally, we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion.

JUDICIAL FORUM FOR LEGAL DISPUTES

Unless you and we agree otherwise, in the event that the Agreement to Arbitrate above is found not to apply to you or to a particular claim or dispute, either as a result of your decision to opt out of the Agreement to Arbitrate or as a result of a decision by the arbitrator or a court order, you agree that any claim or dispute that has arisen or may arise between you and econorepairs.com must be resolved exclusively by a state or federal court located in Midland/Odessa, Texas. You and econorepairs agree to submit to the personal jurisdiction of the courts located within Midland/Odessa, Texas for the purpose of litigating all such claims or disputes.

GENERAL

Except as otherwise provided in this User Agreement, if any provision of this User Agreement is held to be invalid, void or for any reason unenforceable, such provision shall be struck out and shall not affect the validity and enforceability of the remaining provisions. In our sole discretion, we may assign this User Agreement, and in such event, we will post notice on www.econorepairs.com.

Headings are for reference purposes only and do not limit the scope or extent of such Section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this User Agreement.

We may amend this User Agreement at any time by posting the amended terms on www.econorepairs.com. Our right to amend the User Agreement includes the right to modify, add to, or remove terms in the User Agreement. We will provide you 30 days' notice by posting the amended terms. Your continued access or use of our Services constitutes your acceptance of the amended terms. We may also ask you to acknowledge your acceptance of the User Agreement through an electronic click-through.

The policies and terms posted on our Services may be changed from time to time. Changes take effect when we post them on our site.

If you create or use an account on behalf of a business entity, you represent that you are authorized to act on behalf of such business and bind the business to this User Agreement. Such account is owned and controlled by the business entity. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this User Agreement.

The User Agreement and all terms and polices posted through our Services set forth the entire understanding and agreement between you and Econo Repairs, and supersede all prior understandings and agreements of the parties. The following Sections survive any termination of this User Agreement: Fees, Content, Disclaimer of Warranties; Limitation of Liability; Release, Indemnity, Legal Disputes, and General.

If you are a California resident, in accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 400 R Street, Sacramento, CA 95814, or by telephone at (800) 952-5210.

RELEASE

If you have a dispute with one or more users, you release us (and our affiliates and subsidiaries, and our and their respective officers, directors, employees and agents) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. In entering into this release you expressly waive any protections (whether statutory or otherwise) that would otherwise limit the coverage of this release to include only those claims which you may know or suspect to exist in your favor at the time of agreeing to this release.

INDEMNITY

You will indemnify and hold us (including our affiliates and subsidiaries, as well as our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of this User Agreement, your improper use of Econo repairs 's Services or your breach of any law or the rights of a third party.

INSURANCE

During the Term of this Agreement specialist shall maintain the following insurance coverage:
  1. Adequate property and casualty insurance to replace units or any parts thereof or that customers brought in for repairs that are lost, stolen, or damaged
  2. Workers’ Compensation in the statutory amounts required by the applicable state laws
  3. Commercial General Liability Insurance (CGL) with a minimum limit of $1,000,000.00 per occurrence
  4. Any other insurance coverage that Specialist is required to carry to comply with applicable laws or meet industry standards. Econo Repairs shall be added as an additional insured for the limited purpose of claims arising pursuant to this Agreement, and specialist will provide evidence of the insurance to Econo Repairs

EXHIBIT A – PROCESS AND REQUIREMENTS

INTRODUCTION

This Statement of Process and Requirements ("P&R") sets forth the process and steps required for specialists/ independent cell phone repair shop owners, and Freelance repair technicians, or on demand repair technicians to meet the minimum standards of device repairs processed through Econo Repairs Marketplace. All providers of device repair services will be referred here as Specialists. Econo Repairs will be referred as Econo Repairs (ER). Repair services provided by the specialists are governed by and subject to the terms and conditions specified in the Specialist Agreement ("Agreement").

SUMMARY OF SERVICE

Econo Repairs will connect customers seeking repairs on their devices with the specialists. Customers will have the choice of selecting a quote from the available specialists quotes in the Econo Repairs Marketplace. When a specialist creates an online quote, and the quote is selected by a customer, Specialist is bound to honor his given quote as long as the customer brings the device in the given timeframe and the customer has correctly identified the device problem. It is the Specialist’s responsibility to verify and correct all quotes posted on www.econorepairs.com. It is the responsibility of shop owner (Specialist) to ensure that all persons, whether employees, subcontractors, or anyone acting for or on behalf of the specialist, are properly licensed, certified or trained as required by applicable law and are suitably skilled, experienced and qualified to perform the repairs and services. Specialist will also ensure that all of the equipment used in the provision of the Services is in good working order and suitable for the purposes for which it is used.

TYPE(S) OF SERVICE

On Site Repair – Specialist will show up at customer’s location to repair the device
Customer drop off - Customer will drop device at the Specialist location where repair will be performed

PROCESS

  1. SPECIALISTS
    1. Specialist will sign up with Econo Repairs
    2. After the account approval, specialist will create quotes for different repair services with prices for parts that are in stock. No quotes for out of stock parts or repairs
    3. When a customer selects a quote, customer details with the appointment time (if there is one) will become visible in the specialist dashboard. Specialist will also receive phone and email notification. Same day contact by specialist is must if the order is received during specialist’s business hours
    4. Customer brings the device to specialist location (or Freelance specialist goes to customer location)
    5. Specialist matches the quote with the actual device model and condition/damage (for example broken screen for iphone 6 plus. So, the quote must be for Iphone 6 plus broken screen, and the device received must be an iphone 6 plus with only broken screen)
    6. Specialist tests the device in customer’s presence for additional problems
    7. If additional problems are found at device drop off time, customer must be notified at the time of device drop off. Customer either agrees to pay for additional repairs, or decides to proceed with only quoted repair. If the customer decided not to proceed with the quoted repair work, Specialist must cancel the order with a detailed reason in the specialist notes section. Three cancellations of online orders in a 30-day period through Econo Repairs will disable Specialist account
    8. Specialist will make notes of additional problems by writing comments in the diagnostic box and print a receipt for the customer
    9. If customer agrees to do the additional repairs, specialist will select additional problem statements, update the revised costs, update the order, and print a receipt for the customer
    10. Specialist also will change the status to “Device accepted for repair”
    11. When the device is repaired, specialist will change the status to “Device ready for pick up”
    12. At the time of pick up, specialist will test the device with the customer for all functions
    13. Specialist will also process any additional payments either through the Econo Repairs payment system or through the specialist’s own system. Any system selected must be updated in the Econo Repairs system
    14. Devices must be repaired the same day, or an extension for next day duly approved by the customer if the repair cannot be completed the same day
    15. After payment specialist will update the device status to “Device picked up”
    16. Funds minus 10 % will become available in the Specialist wallet after 3 business days. 10 % is a special promotional rate that will change to 15 % without notice at the start of 2020 for all specialists
    17. If and when a customer raises a dispute about a repair job or part, Specialist will be notified. It is the specialist’s responsibility to promptly contact the customer and resolve the dispute. When the dispute is resolved, Specialist will change the dispute status to “Resolved”
    18. Econo Repairs will confirm the dispute status with the customer
    19. Dispute by a customer will change the status of funds in specialist wallet to “funds on hold”. For unresolved disputes specialist will not receive funds. If funds were already paid out, they will be debited from specialist account
    20. After dispute resolution confirmation by the customer, funds on hold will be released to the specialist
    21. In case of accidental damage to customer’s device by the specialist, it is the specialist’s responsibility to resolve the complaint or replace the customer device
    22. Econo Repairs does not have control over the repair process or customer input. Specialists are responsible to contact the customer, complete the repair work and avoid a charge back. Econo Repairs is a marketplace connecting customers and specialists.
  2. FREELANCE SPECIALISTS
    1. Specialist will sign up with Econo Repairs
    2. After the account approval, specialist will create quotes for different repair services with prices for parts that are in stock. No quotes for out of stock parts or repairs
    3. When a customer selects a quote, customer details with the appointment time (if there is one) will become visible in the specialist dashboard. Specialist will also receive phone and email notification
    4. Specialist will contact customer to meet at customer location for the device repair same day or latest by next day. Same day contact is must
    5. Specialist matches the quote with the actual device model and condition/damage (for example broken screen for iphone 6 plus. So, the quote must be for Iphone 6 plus broken screen, and the device received must be an iphone 6 plus with only broken screen)
    6. Specialist tests the device in customer’s presence for additional problems before starting any repair
    7. If additional problems are found, customer must be notified before starting any repair
    8. Customer either agrees to pay for additional repairs, or decides to proceed with only quoted repair. If the customer decided not to proceed with the quoted repair work, Specialist must cancel the order with a detailed reason in the specialist notes section. Three cancellations of online orders in a 30-day period through Econo Repairs will disable Specialist account
    9. Specialist will make notes of additional problems by writing comments in the diagnostic box
    10. If customer agrees to do the additional repairs, specialist will select additional problem statements, update the revised costs, update the order, and print a receipt for the customer
    11. Specialist also will change the status to “Device accepted for repair”
    12. When the device is repaired, specialist will change the status to “Device ready for pick up”
    13. At the time of pick up, specialist will test the device with the customer for all functions
    14. Specialist will also process any additional payments either through the Econo Repairs payment system or through the specialist’s own system. Any system selected must be updated in the Econo Repairs system
    15. Devices must be repaired the same day, or an extension for next day duly approved by the customer if the repair cannot be completed the same day
    16. After payment specialist will update the device status to “Device picked up”
    17. Funds minus 10 % will become available in the Specialist wallet after 3 business days. 10 % is a special promotional rate that may change to 15 % without notice at the start of 2020 for all specialists
    18. If and when a customer raises a dispute about a repair job or part, Specialist will be notified. It is the specialist’s responsibility to promptly contact the customer and resolve the dispute. When the dispute is resolved, Specialist will change the dispute status to “Resolved”
    19. Econo Repairs will confirm the dispute status with the customer
    20. Dispute by a customer will change the status of funds in specialist wallet to “funds on hold”. For unresolved disputes specialist will not receive funds. If funds were already paid out, they will be debited from specialist account
    21. After dispute resolution confirmation by the customer, funds on hold will be released to the specialist
    22. In case of accidental damage to customer’s device by the specialist, it is the specialist’s responsibility to resolve the complaint or replace the customer device
    23. Econo Repairs does not have control over the repair process or customer input. Specialists are responsible to contact the customer, complete the repair work to customer satisfaction, and avoid a charge back. Econo Repairs is a marketplace connecting customers and specialists.
  3. EXCEPTIONS
    1. When customer has been contacted but customer does not drop off a device for repair. Specialist will inform Econo Repairs after 10 days and write specialist notes “No Show”. Freelancer specialist will do the same if there is no contact with the customer to set up date and time of repair
    2. If the device cannot be repaired (for example extensive water damage, short circuit etc.) or for devices that are dead on arrival, specialist will write in diagnostic comments “Dead on arrival” Repair not Guaranteed” and diagnostic fee if any. Specialist will also inform customer verbally

REPAIR WARRANTY

All specialists will warranty their parts and labor for 90 days. Anytime time a dispute arises, specialists will make their best efforts to resolve the disputes within two days. Econo Repairs will not be held responsible for failed repairs or parts. Three disputes or chargebacks in a month will disable your account. Also, while we may help facilitate the resolution of disputes, final outcome of any dispute will depend on the willingness of both parties to work together in resolving a dispute. Econo Repairs will use its best efforts to resolve any dispute in a fair manner. You agree to allow Econo Repairs to contact you by phone or email to help and resolve the dispute. You also agree that any dispute resolution decision by Econo Repairs is final.
